Lil Durk secured a significant legal win after a $12.5 million lawsuit against him was dismissed as he faces federal murder-for-hire charges.
According to court filings reviewed by Complex, all claims brought by Exceed Talent Capital against Durk (born Durk Derrick Banks), his label Only The Family, and OTF Label have been “dismissed with prejudice,” meaning they cannot be refiled.
The dismissal also specifies that neither side will recover legal fees, and that Durk has "waived his right to appeal."
The lawsuit, filed in 2023, accused Durk and his former manager, Andrew Bonsu, of fraud over a failed investment involving the rights to Durk's song "Bedtime." Exceed claimed it had been misled into believing it purchased perpetual rights to the track for $600,000, paying $450,000 before discovering Durk's exclusive deal with Sony Music's Alamo Records made the contract invalid.
Exceed said in 2023 the company “received a demand letter from Alamo Records… advising Exceed that [Lil Durk] was signed to an exclusive recording agreement with Alamo and that neither defendants nor [music distributor] Empire possess any right… to assign any interest in the revenue streams generated” by the "Bedtime" track.
Meanwhile, Durk is expected to go to trial for his murder-for-hire case next January. In September, it was reported that the Chicago rapper, who has been charged with conspiracy and intention to commit murder-for-hire, likely had his trial postponed in 2026 due to its "unusual and complex" nature.
