A sober person would have thought to call a taxi.

A man in Pennsylvania by the name of Nicholas Lucke had a good time, got drunk, and started to drive home (strike one). When he realized he shouldn't be driving, he pulled over (remove one strike). He called the Pennsylvania State Police (two strikes), and sat in the driver's seat of his running Kia Spectra until they arrived (strike three). While the police were no doubt happy that Lucke did the right thing and stopped driving, they had no choice but to charge him with a DUI.

If he wasn't drunk he might have thought to call a taxi instead.
