The family of James McNair, the man who was killed in the crash that injured Tracy Morgan, settled its lawsuit with Walmart last month. Now TMZ is reporting the settlement awarded to McNair's children was worth $10 million.

Last summer a Walmart truck driver crashed into the limo bus containing Morgan and his friends. Two other passengers were severely injured, and another broke his wrist.

Kevin Roper, the driver of the truck, tried to have Morgan's ongoing lawsuit delayed until his own criminal trial was completed. He argued the lawsuit would interfere with his right to a fair trial, but a judge denied his request.

Today Morgan's lawyer released an update on Morgan's condition: "Tracy is working very hard to get better, physically, emotionally and mentally. Because in all three areas he still has a struggle on his hands." He also said the comedian was "incredibly moved" by the Saturday Night Live tribute to him but isn't "emotionally ready" to watch it yet.
