The last-ditch appeal to save the New York City soda ban has been shot down, once and for all.

According to Gothamist, Judge Eugene Pigott Jr. delivered the ruling, explaining that the Department of Health tried to overstep its boundaries:

With the nail firmly embedded in the coffin, the DOH will seek alternatives to combat diabetes and obesity in the city. "We will continue to look for ways to stem the twin epidemics of obesity and type 2 diabetes by seeking to limit the pernicious effects of aggressive and predatory marketing of sugary drinks and unhealthy foods," Health Commissioner Mary Bassatt explained.
