An NYPD officer who was filmed stomping a suspect over the summer will reportedly be indicted on misdemeanor assault charges today, officials say.

According to the New York Daily News, Officer Joel Edouard was seen stomping the head of Jahmiel Cuffee, 32, in Brooklyn on Jul. 23. Cuffee was handcuffed and pleading for help at the time.

The Daily News adds that the 36-year-old Edouard allegedly approached Cuffee after witnessing him throw away a joint which he had just rolled. However, a law enforcement source told the Daily News that there was no evidence of marijuana found at the scene, and that Cuffee only faced charges for obstructing governmental administration and attempted tampering with evidence. Both charges were dropped in December.

Edoaurd, who was placed on desk duty following the incident in July, is expected to surrender today. If convicted, he could face up to a year in jail.
