NYPD Spokesman Says Only $62 Was Seized During Brooklyn Stop-And-Frisk Caught on Camera

The man's attorney says police are lying.

A Brooklyn man claims that an NYPD officer stole $1,300 from him before pepper-spraying him in the face last month, but police say the money amount of money was far less. 

The incident took place on Sep. 16 during a stop-and-frisk in Coney Island. Video footage shows an officer reaching into the pocket of 35-year-old Lamard Joye, then taking his money. When Joye demanded the officer return it, he was pepper-sprayed in the face. The officer did the same to Joye's sister after she approached and asked for his name and badge number. 

However, police say the amount of money seized was $62, noting that it was vouchered. "No one stole $1,300," NYPD Deputy Commissioner Stephen Davis said, according to the New York Daily News

Joye's attorney, Robert Marinelli, contests this, arguing that the $62 was taken from another man. "The NYPD is denying what they can’t admit, and admitting what they can’t deny," he said, adding that "the video does not lie." 

The confrontation is being investigated by the NYPD's Internal Affairs division, as well as the Brooklyn District Attorney's office.
