The driver in last weekend’s traffic accident that left comedian Tracy Morgan in critical condition pleaded not guilty today in a New Jersey court room, according to USA Today. Kevin Roper’s attorney, David Glassman, entered the plea for the Wal-Mart truck driver, who is charged with one count of vehicular homicide and assault by auto against four individuals. Roper remains free on $50,000 bail.

According to the article, New Jersey law allows for a person to be charged with assault by auto if they cause any vehicular injury after being awake for more than 24 hours, which Roper allegedly was. The accident left one man, James McNair, Morgan’s mentor, dead, and caused four others, including Morgan himself, to be airlifted to a nearby hospital.

Morgan suffered broken leg bones, a broken nose, and broken ribs in the crash, and he has since been in and out of surgery. Morgan is expected to remain in the hospital for a few weeks, and there has been no change in his condition, which is still listed as critical.
