The body-shaming playmate Dani Mathers could be headed to jail.

According to TMZ, Mathers will be charged for the Snapchat she posted in July featuring a photo of a naked woman in a gym locker room with a caption that read “If you can’t un-see this, I can’t either.” Mathers was promptly excoriated online, despite issuing a public apology. “That was absolutely wrong and not what I meant to do,” she said at the time. “I know that body-shaming is wrong. That is not the type of person I am.”

After police located the elderly woman in the photo, she decided to pursue charges, which were filed by her L.A. city attorney Mike Feuer on Friday. Mathers faces one count of invasion of privacy, and faces up to six months in jail if convicted.

“Body-shaming is humiliating, with often painful, long-term consequences,” Feuer said in a statement. “It mocks and stigmatizes its victims, tearing down self-respect and perpetuating the harmful idea that our unique physical appearances should be compared to air-brushed notions of ‘perfect.’”

While the former Playmate of The Year has yet to comment, her attorney Tom Mesereau told People that his client doesn’t deserve to be charged with a crime because she “never tried to break any law.” However, Feuer argues that while body-shaming may not be illegal, the illicit tactics Mathers used to obtain then post the photo constitutes an invasion of privacy. “We shouldn’t tolerate that," he added.

Back in September, Mathers seemed at peace with what she’d done, tweeting, “I have taken full responsibility for the mistakes I have made & will continue to love myself & others...I wish this for the rest of you too.”

She’s due in court on Nov. 28.
