An Arizona Man Was Arrested for DUI With a BAC of 0.00

He says "it was a case of driving while black."

This is Jesse Thornton, he's a 61 year old retired fireman who is married to an ER nurse, making him exactly the kind of person you'd like to have as a neighbor (assuming that sexy single woman who keeps giving you fourth chances because the show's writers tell her to isn't an option). When he was pulled over for allegedly crossing a white line at 11 am (he sleeps during the day so that he's on the same schedule as his wife) two officers walked up to him and told him "I can tell you're driving DUI by looking in your eyes." Thornton, ignoring the redundancy of saying "driving DUI," and explained that his eyes might have been bloodshot from having just come from his gym's pool, where he was exercising.

The officers then informed Thornton that they were going to administer a sobriety test, which Thornton agreed to even though he was scheduled for hip surgery the next week. After the test, he was arrested for DUI, and when he asked the officer in front of him to move her seat up, because his hip was hurting, she told him to "quit whining." 

When he arrived at the station, he blew a BAC of 0.00 and the drug recognition expert stated “I would never have arrested you...in my opinion Jessie was never under the influence of drugs or alcohol.”

Thornton is now suing the country and his attorney is chalking it up to another case of "DWB, driving-while-black."
