Shia LaBeouf’s Lawyer Says LaBeouf’s ‘Racist B*tch’ Comment Is Protected Under Free Speech

Shia LaBeouf is currently trying to beat a defamation lawsuit filed against him by a bartender following an incident that took place back in April. The conflict began after LaBeouf, who consumed alcohol at the establishment to the possible point of intoxication, was refused service, angering the actor to the point of yelling. The bartender, named David Bernstein, then grabbed a Grey Goose bottle to defend himself. 

"I’m asking you about french fries, and you want to hit me in the head with a Grey Goose bottle," Shia yelled. "You fucking racist bitch—you fucked up!" The incident was, of course, caught on camera, courtesy of TMZ

LaBeouf​'s ​attorney Brian G. Wolf is now formally asking a California judge to throw out the lawsuit. Wolf made the argument that the actor's actions are protected under the First Amendment, and insisted the lawsuit filed against his client has no legs to stand on. 

Wolf also wrote that Shia's "celebrity status turned what would have otherwise been a wholly private encounter... into a matter of significant public interest." He continued, "This action amounts to little more than attempted civil extortion."
