A Florida man facing federal mail fraud and immigration charges wants to institute a unique defense to prove his innocence: Having his sex tapes played in court.
After firing his last six lawyers, Brazilian native Rogerio Scotton, 43, is representing himself against accusations of running a multi-million dollar mail fraud scheme involving companies such as UPS, DHL and FedEx that fraudulently charged other companies like Apple, Target and Wal-Mart between 2007 and 2012.
He's probably screwed on those, but figures that if the court sees the sex tapes he made with his wife, they'll believe that he married her for legitimate reasons—not to cement his status as a permanent resident.
A judge said she would be more comfortable if Scotton and the prosecution reache somde type of deal that didn't involve the court viewing his home movies, but he was having none of that. "Why is the privacy of my wife important at this point?" he argued. "I'm facing jail time."
He has a point—it's all or nothing right now.
