Naeem Davis, the man who was arrested for pushing 58-year-old Ki-Suk Han onto the subway tracks at the 49th Street subway station in Manhattan on Monday, has been formally charged with two counts of second degree murder. Davis allegedly admitted to pushing Han in front of the train following an altercation at the station.

Davis reportedly told investigators that he pushed Han because Han wouldn't leave him alone. He also told police that he saw the train strike Han, as he remained on the platform. He was arrested on Tuesday afternoon at 50th Street and Seventh Avenue, about a block away from where the incident occurred.

According to the New York Times, Davis had been arrested before for minor offenses such as peddling.
