New York High Court Rules That Lap Dances Can Be Taxed

New York's highest court ruled that lap dances are not art because they do not promote culture, therefore they are taxable. The court came to a 4-3 decision, but some judges felt that there was no distinction between "highbrow dance and lowbrow dance," thus creating "significant constitutional problems" with the case.

Nite Moves in Albany filed the lawsuit, which claimed that strip club admission and private dance fees should be exempt from taxes. The court ruled that entertainment venues are subject to taxes, saying that the club failed to explain how it qualified for exemption for "dramatic or musical arts performances."

Nite Moves should know that Uncle Sam will get his hands on everything if given the chance.
