Back in February, famed photographer David LaChapelle said he was suing Rihanna over her "S&M" video. He claimed it copied the “composition, total concept, feel, tone, mood, theme, colors, props, settings, decors, wardrobe and lighting of his work.”
MTV reports that a court acknowledges that at least one scene in the video— Rihanna dominating a man in front of pink and white striped walls— has some similarity to LaChapelle's photo portrait 'Striped Face," and now they'll be headed to pre-trial August 10th.
"I like RiRi," says LaChapelle. "This is not personal, it's strictly business. Musicians commonly pay to sample music or use someone's beats and there should be no difference when sampling an artist's visuals."
